Is there a way to turn this off so active list members don't get punished for failed delivery of list messages?

What version of smartlist are you using? Some problems re: counting bounces against the sender instead of the receiver were fixed in recent versions.

Asking them what version they installed would be a good start. If you have shell access to the machine where SmartList is installed you can invoke the flist binary with the -v option---look in the .bin subdirectory of the smartlist 'home'.
